The difference between mediation and arbitration is that mediation is a collaborative negotiation facilitated by a neutral party and arbitration is a fact-finding process whereby one or three arbitrators render a decision which typically is binding. ADR is often the preferred dispute resolution method because it:
- allows for solutions that might be unavailable through the courts;
- is more cost-effective than litigation;
- produces more timely results;
- provides results that are less public than court resolutions;
- with mediation, allows greater party input into the resolution of the matter.
Amy Rothstein serves as a mediator and arbitrator in cases involving securities, employment discrimination, contract and other commercial disputes. She is on the mediator panels of the American Arbitration Association (AAA),the Financial Industry Regulatory Authority,the Southern and Eastern Districts of New York, and the Commercial Division of the New York State Supreme Court.
